Citizen Effect is a non-profit organization dedicated to creating partnerships between individual fundraisers (“Citizen Philanthropists”) and high-need communities who have the local knowledge, skills, and drive to overcome poverty, but lack adequate resources to do so. Citizen Effect works with grassroots partners to develop basic infrastructure improvements in Water & Sanitation, Education, Food Security, Clean Energy, and Heath.

Citizen Effect donations are grants, not loans. The CitizenEffect.org website is a platform for linking Citizen Philanthropists with identified projects in need of funding. These terms of service govern use of the CitizenEffect.org website. If you have any questions about these Terms of Service, please refer your inquiries to info@citizeneffect.org.

By using the CitizenEffect.org website, you accept and agree to be bound by the following Terms of Service. Nothing in these Terms of Service should be construed to confer any rights to third party beneficiaries. We also reserve the right to modify these Terms of Service from time to time without notice. You are responsible for regularly reviewing these Terms of Service so that you will be apprised of any changes.

Use of Website

You understand that any and all decisions made by you with respect to donation are yours alone. While Citizen Effect does its best do verify the legitimacy of field partners, it cannot guarantee the accuracy of information from its field partners. Citizen Effect reserves the right to modify or terminate the CitizenEffect.org service or disable your access to the website for any reason, and without notice, without liability to you or any third party. If you are not at least 13 years of age, you may not use the CitizenEffect.org Website, Links, or Website Content.

The CitizenEffect.org website may include links to third party websites. These links do not mean that Citizen Effect endorses or controls these third party sites or services. You acknowledge and agree that Citizen Effect is not responsible or liable for any content or other materials on these third party sites.

Citizen Effect is not responsible, and shall have no liability, for any incorrect or inaccurate Content posted on the Website. With respect to the Website, Citizen Effect assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, any communications. Under no circumstances will Citizen Effect be responsible for any loss or damage resulting from any use of the Website, any Content posted on the Website or transmitted to, or any interactions between, any users of the Website, whether online or offline.

Citizen Effect shall not be responsible, or have any duty or obligation to, or liability for: (a) decisions or interactions resulting (directly or indirectly) from making a donation; or (b) any damages, costs, losses or expenses a Citizen Philanthropist incurs as a result (directly or indirectly) of making a donation. In addition, in no event will Citizen Effect be liable to you or any other person for any damages, costs, losses or expenses, including any lost capital, lost profits or special, incidental, consequential or punitive damages arising from your use of the Website or participation as a donor, even if Citizen Effect has been advised of the possibility of such damages, costs, losses or expenses. The CitizenEffect.org website, including but not limited to web site content, text, photographs, video, audio and graphics (“Content”), are the exclusive property of Citizen Effect, its licensors, or other owners. In addition, the Site contains certain trademarks or other designations (“Trademarks”) that are owned by Citizen Effect or their respective owners. The Citizen Effect logo, tagline and "CitizenEffect.org" are trademarks of Citizen Effect. All rights in such Intellectual Property are expressly reserved and no such Content or Trademarks may be used, reproduced, and/or distributed without the express permission from Citizen Effect or the respective owners.

THE WEBSITE, INCLUDING ANY CONTENT OR INFORMATION CONTAINED WITHIN IT OR ANY SERVICE OR ADVICE PROVIDED IN CONNECTION WITH THE SERVICES, IS PROVIDED "AS IS" WITH NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. YOU ASSUME TOTAL RESPONSIBILITY AND RISK FOR YOUR USE OF THIS SITE AND SITE-RELATED SERVICES. Without limiting the generality of the foregoing, Citizen Effect neither represents, warrants, covenants guarantees, nor promises any specific results from use of the Website.
 
Some states do not allow exclusion of implied warranties or limitation of liability for incidental or consequential damages, so the above limitations or exclusions may not apply to you. In such states, our liability shall be limited to the greatest extent permitted by law.
 

Entire Agreement

These Terms of Service constitute the entire agreement between you and Citizen Effect with respect to the subject matter hereof and supersede all other understandings or agreements, written or oral, regarding such subject matter. If any part of these Terms of Service is determined to be invalid or unenforceable pursuant to applicable law, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision, and the remainder of the Terms and Conditions shall continue in effect.
 

Disputes with Citizen Effect and Jury Trial Waiver

If there is any dispute about or involving Citizen Effect or its Website, by using the Website, you agree that the dispute will be governed by the laws of the District of Columbia without regard to its conflict of law provisions. You agree to personal jurisdiction by and venue in the federal courts located in the District of Columbia. TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU HEREBY WAIVE YOUR RIGHT TO A JURY TRIAL OF ANY CLAIM OR CAUSE OF ACTION ARISING OUT OF OR BASED UPON THIS AGREEMENT OR ANY CONTEMPLATED USE HEREIN, INCLUDING CONTRACT, TORT, BREACH OF DUTY AND ALL OTHER CLAIMS. THIS WAIVER IS A MATERIAL INDUCEMENT FOR THE PARTIES TO ENTER INTO THIS AGREEMENT.
 
WITHOUT INTENDING IN ANY WAY TO LIMIT YOUR AGREEMENT TO WAIVE YOUR RIGHT TO A TRIAL BY JURY, if the above waiver of the right to a trial by jury is not enforceable, you agree that any and all disputes or controversies of any nature between you and Citizen Effect arising at any time shall be resolved by binding arbitration, decided by a reference to a private judge, mutually selected by you and Citizen Effect and you waive, to the maximum extent not prohibited by law, any right you may have to claim or recover in any legal action or proceeding referred to in this section any special, exemplary, punitive or consequential damages.
